Terms and Conditions

1.1. Kiss Tour offers an online tool via its Website that enables you to browse information about tours and make bookings, also known as "Book now". Once you place an order through the Website, you can book your preferred pick-up time and location, as well as your preferences in Vietnam. We will send you a booking confirmation via email or any other convenient means.

1.2. There may be changes in market conditions or circumstances, such as weather or force majeure, that can occur unexpectedly, leading to a change in the accuracy of the information provided. In the event of any problems, our customer service department will get in touch with you to assist you and answer any questions you may have.

1.3. You can make payments directly in cash or through other Kiss Tour payment channels.

2.1. With the advantage of flexible time and location, don't worry if you can't join us this time. Make sure everything is okay with you, and we're glad you're okay. If possible, please contact and notify us of the cancellation in advance of the appointment time for the convenience of both parties. We are always ready to listen and suggest the most convenient time for you.

3.1. In case of any special requests related to the booking (e.g., name change, date change), the User can add the requests when making the booking on the Website or contact us directly.

4.1. The ratings displayed on the Website are for informational purposes only, and the existing ratings are based on information provided by third parties, such as Users or other review websites (Tripadvisor, Google Maps).

5.1. Payments are made in the amount and currency specified without any bank guarantee fees or other charges charged by Kiss Tour.

5.2. Kiss Tour does not charge taxes or fees. The costs have been pre-announced and there are no additional charges.

5.3. Payment methods include cash or bank transfers. For payment by bank transfer, you must provide the bank to [email protected] receipt as proof of payment of reservations listed in the Kiss Tour confirmation email. You must follow the procedures contained in the confirmation email.

5.4. After you complete the booking confirmation, Kiss Tour will place the order, which will be accompanied by:

(i) Customer Name;

(ii) Booking Information; and

(iv) Phone Number / Extension Number.

6.1. Kiss Tour is the sole owner of all the content on the Website. You are permitted to use the Website to make bookings, but you must not make false or speculative bookings that could prevent others from making bookings. You confirm that the payment information you provide is true and accurate, and you agree to provide your correct email address, mailing address, and contact information.

6.2. You are not allowed to use the Site or the Content for commercial purposes or for anything other than personal use or any purposes that are prohibited by law. You must not engage in any activities that violate these Terms. Without the written consent of Kiss Tour, you must not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, or re-sell any information, software, products, or services obtained through the Site. Furthermore, you must agree not to:

6.3. When you make a purchase on the Site, you confirm that you are not restricted by any sanctions program or subject to penalties under any anti-money laundering regulations.

7.1. Kiss Tour owns all Intellectual Property Rights on this Website. Posting, modifying, copying, reproducing, creating copies or modifying any information or materials, including but not limited to software, text, data, graphics, images, audio, video, trademarks, logos, icons, html codes and other codes on this Website without Kiss Tour's permission is a violation of Intellectual Property Rights. Kiss Tour reserves the right to take legal action against you to claim damages if you violate these rights. Violations may constitute a crime.

7.2. You may only use the information on the Website for personal, non-commercial purposes. Unless otherwise specified and expressly permitted by copyright law, you may not copy, reproduce, redistribute, retransmit, publish or commercially exploit any content you download from the Website without the permission of the owner of the Intellectual Property Rights. Even if you obtain the necessary permission, you may not modify or delete the content. You agree that downloading any Content does not grant you any Intellectual Property Rights in that Content.

8.1. If you or your representative (collectively referred to as the "Sender") have evidence of infringement of your Intellectual Property Rights, you may submit a notice with the following details:

8.2. Kiss Tour will review and handle notices in accordance with the above requirements and in accordance with Vietnamese law.

8.3. You agree to indemnify and hold Kiss Tour harmless from any loss or damage that may occur due to fraud, forgery or allegations of intellectual property infringement.

10.1. You are responsible for compensating Kiss Tour, its employees, affiliates, employees, and partners for any claims, demands, liabilities, damages, or losses, including legal fees, resulting from a third-party claim related to: (a) your use of the Website; (b) the content you submit, provide or access through the Website; (c) your violation of the Terms; (d) your violation of any other rights or obligations; and/or (e) any act or omission by you, whether negligent, illegal or otherwise.

11.1. The Website may contain links to websites operated by parties other than Kiss Tour. We cannot control the content or activities of websites or links we provide. Third parties, including us, may upload automatic search results or links to other websites. This Website allows third parties to share information, data, text, images, audio, graphics, video, messages, reviews, or other materials ("Content"). We do not review or control the website, source, or content. By using the websites or sources we provide, you agree that we are not responsible for their content or availability, and we do not endorse or recommend them. You also agree to indemnify us from any liability, costs, losses, or damages directly or indirectly caused by or in connection with your use of such content, website, or resource.

12.1. Kiss Tour holds complete authority to make decisions regarding modifications, postponements, suspensions or terminations of this Website and/or its components, which includes the services or products provided through this Website, and/or the utilization of this Website, or any of its components, at any given time and for any purpose, without prior notice to you.

13.1. The regulations mentioned will be subject to Vietnamese law and interpretation.

14.1. In case of any disagreement arising from or concerning these Terms, both parties will initially engage in a sincere and constructive discussion to resolve the issue within 60 days of receiving a notice of dispute. If they fail to reach a mutually acceptable solution through negotiations within the given time frame, the matter shall be referred to a competent dispute resolution body based in Vietnam.

15.1. The agreement between you and Traveloka regarding the subject matter of these Terms is fully stated in these Terms. Any previous agreements, whether written or oral, between you and Traveloka on the subject matter of these Terms are no longer in effect and have been replaced by these Terms.
